What about those people whose services you may use but who are not your employees? Ensure that you are absolutely clear about the distinctions between these groups of workers and that you don't treat them as employees, thus unwittingly giving them employment rights.

What's new?
  • Agency workers: confirmation from the ECJ that the fixed-term workers regulations only apply to those who are employed directly by the end user, and not to agency workers.

  • Employee-shareholder schemes: this new status WILL now go ahead following a number of amendments. The provisions are included in the Growth and Infrastructure Act and are expected to take effect in autumn 2013.
